A1. About us

A1.2 Our Products are produced by Prime Food Service, Pattaya, under Thai FDA registration number 20-2-00757-6-0133.

A3. Scope and order of precedence

A3.1 These Terms of Sale apply to every sale. Our Trade Terms also apply to Trade Customers. Our Buy Back Scheme Terms apply to claims under the Buy Back Scheme. All three documents, together with our Privacy Policy and Cookies Policy, are published on our Website.

A3.2 If there is a conflict, the order of precedence is: (a) any written agreement signed by both parties; (b) our Buy Back Scheme Terms, for Buy Back Scheme claims; (c) our Trade Terms, for Trade Customers; (d) these Terms of Sale.

A3.3 No other terms apply, including any terms on a Trade Customer's purchase order, unless we agree to them in writing.

A3.4 Nothing in these terms excludes or limits any right a Consumer has under Thai law that cannot be excluded or limited by contract.

A4. Eligibility

A4.1 You must be at least 20 years old, or have the consent of a parent or guardian, to place an Order.

A4.2 We deliver to addresses throughout Thailand. We do not currently deliver outside Thailand.

A4.3 You must give accurate and complete information when ordering. We may cancel any Order where information is false or incomplete.

A5. Products

A5.1 Product images are for illustration. Because our jerky is handcrafted in small batches from natural ingredients, its colour, texture and piece size may vary between batches. This is not a defect.

A5.2 Net Weight is declared at the time of packing. Jerky can lose a small amount of moisture over its shelf life, and minor variation within the limits permitted by Thai law is not a defect.

A5.3 Ingredient, allergen, nutrition and storage information is printed on every pack. The pack label prevails over any description on the Website or in our marketing. Please read the label before eating.

A5.4 All Products are subject to availability. If a Product becomes unavailable after you order, we will tell you and refund any payment for it.

A6. Orders and how the Contract is formed

A6.1 Your Order is an offer to buy. A Contract is formed when we confirm your Order in writing (including by email or LINE message) or dispatch the Products, whichever is earlier.

A6.2 An automatic acknowledgement of your Order is not acceptance.

A6.3 We may refuse any Order, including where we suspect fraud, resale through a Consumer account, or a pricing error. If we refuse an Order, we will refund any payment in full.

A6.4 We may limit quantities per Order or per Customer.

A7. Prices

A7.1 Prices are in Thai Baht (THB). Delivery charges are shown separately before you confirm your Order.

A7.2 The price that applies is the one shown when you place your Order. We may change prices at any time, but changes do not affect Orders already confirmed.

A7.3 If a Product is listed at an obviously incorrect price because of an error, we are not obliged to supply it at that price. We will contact you, and you may either confirm the Order at the correct price or cancel it for a full refund.

A8. Payment

A8.1 Payment must be made in full before dispatch by PromptPay or bank transfer to the account details we provide.

A8.2 Cash payment is accepted only for in-person sales or collections, and only where we agree to it in advance.

A8.3 Your Order will not be dispatched until we have received cleared payment. Please keep your payment slip as proof of payment.

A9. Delivery

A9.1 We deliver to the address you give us anywhere in Thailand. Any delivery times we give are estimates, not guarantees. Where no time has been agreed, we will deliver within 30 days of the Contract being formed.

A9.2 We are not responsible for delays caused by couriers, incorrect or incomplete addresses, failed delivery attempts, or events outside our control (clause A18).

A9.3 If a parcel is returned to us because no one was available to receive it or the address was wrong, we may charge you the cost of redelivery, or cancel the Order and refund the Product price less the delivery costs we have incurred.

A9.4 Collection or hand delivery may be offered at our discretion.

A10. Risk and ownership

A10.1 Risk in the Products passes to you on Delivery.

A10.2 Ownership of the Products passes to you when we receive payment in full, or on Delivery, whichever is later.

A11. Food safety, storage and allergens

A11.1 Our Products are ready-to-eat dried beef. Store unopened packs in a cool, dry place out of direct sunlight.

A11.2 Once opened, refrigerate the Product and consume it within 3 days.

A11.3 Do not eat any Product after the expiry date printed on the pack, or if the pack is damaged, swollen or punctured, or the Product shows signs of mould or spoilage.

A11.4 Each pack contains an oxygen absorber packet. It is not food. Do not eat it, and keep it away from children and animals.

A11.5 Our Products contain soy, wheat and fish. If you have a food allergy or intolerance, read the full ingredient list on the pack before eating.

A11.6 Jerky is a firm, chewy product. Supervise children and anyone with chewing or swallowing difficulties.

A11.7 We are not responsible for any loss or harm caused by improper storage, consumption after the expiry date, or failure to follow the instructions on the label after Delivery.

A12. Cancellations, returns and faulty Products

A12.1 Before dispatch. You may cancel an Order free of charge at any time before we dispatch it by contacting [email protected] or our LINE Official Account. We will refund you in full.

A12.2 After dispatch. Because our Products are food, we do not accept returns of unwanted Products for hygiene and safety reasons, except under the Buy Back Scheme, clause A12.3 or clause A12.4.

A12.3 Statutory cancellation (cooling-off) rights. Where Thai law gives a Consumer a right to cancel a purchase within a set period after Delivery, that right applies on the conditions set by law. Any such cooling-off period runs within, and not in addition to, the 30-day period of the Buy Back Scheme. Where the law sets more favourable conditions for a cancellation made within the statutory period, those conditions apply to that cancellation.

A12.4 Faulty, damaged or incorrect Products. If a Product arrives damaged, spoiled, past its expiry date, or is not what you ordered, please tell us within 7 days of Delivery at [email protected], with your order number and clear photos of the Product, pack and label (including the MFG/EXP dates). We will, at our option, replace the Product or refund the price paid for it. We may ask you to return the Product, at our cost, or to dispose of it safely. This clause does not limit your statutory rights in respect of defective goods. Trade Customers should use the Trade Quality Guarantee in clause B7 of our Trade Terms.

A12.5 Refunds are made by bank transfer or PromptPay to an account in the Customer's name.

A13. Our liability

A13.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for liability under the Product Liability Act B.E. 2551 (2008), or for anything else that cannot be excluded or limited under Thai law.

A13.2 Subject to clause A13.1, we are not liable for any loss that was not reasonably foreseeable when the Contract was formed, or for any business loss, including loss of profit, revenue, goodwill or opportunity.

A13.3 Subject to clause A13.1, our total liability to you in connection with any Order is limited to the price paid for that Order.

A13.4 We are not liable for any loss caused by your breach of these terms, misuse of the Products, or failure to follow the storage and label instructions.

A14. Promotions and discount codes

A14.1 Promotions and discount codes are subject to their stated conditions, may be withdrawn at any time, cannot be exchanged for cash, and cannot be combined unless stated.

A14.2 We may cancel Orders, or recover the value of any discount, obtained by misuse, including the use of multiple accounts or codes not issued to you.

A15. Intellectual property

A15.1 The BlackJack Jerky name, logos, characters, packaging designs, recipes, photography, video and all Website content are owned by or licensed to us. You may not copy, reproduce or use them without our written consent, except as permitted under clause B6 of our Trade Terms.

A16. Reviews and content you submit

A16.1 If you send us a review, photo, video or comment, or tag us on social media, you grant us a free, worldwide, non-exclusive licence to use, edit and publish it for marketing purposes, with credit where reasonably practicable.

A16.2 Reviews must be honest, lawful and your own. We may remove any content at our discretion.

A17. Privacy and cookies

A17.1 We handle personal data in line with the Personal Data Protection Act B.E. 2562 (2019) and our Privacy Policy at blackjackjerky.com/privacy. Our use of cookies is explained in our Cookies Policy.

A18. Events outside our control

A18.1 We are not liable for any delay or failure to perform caused by events outside our reasonable control, including natural disasters, flooding, fire, epidemic, government action, ingredient or packaging shortages, courier failure, power or internet failure, or industrial action. If such an event continues for more than 30 days, either party may cancel the affected Order and we will refund any amount paid for Products not delivered.

A19. Changes to these terms

A19.1 We may update these terms by publishing a new version on the Website. The version in force when you place your Order applies to that Order.

A20. General

A20.1 If any part of these terms is found invalid or unenforceable, the rest remains in full effect, and the affected part applies to the fullest extent permitted by law.

A20.2 If we do not enforce a right immediately, we have not waived it.

A20.3 You may not transfer your rights under these terms without our written consent. We may transfer our rights and obligations to another person or entity, including a company incorporated to carry on the BlackJack Jerky business, and will notify you where this affects you.

A20.4 These terms, together with the documents referred to in them, form the entire agreement between us for each Order.

A21. Governing law and disputes

A21.1 These terms, and any dispute arising from them, are governed by the laws of the Kingdom of Thailand.

A21.2 If you have a complaint, please contact [email protected] first. We will respond within 7 Working Days and try to resolve the matter in good faith. If it cannot be resolved within 30 days, the Thai courts have jurisdiction. Consumers may also contact the Office of the Consumer Protection Board (OCPB).

A22. Language

A22.1 These terms may be published in English and Thai. If there is any inconsistency, the English version prevails, unless Thai law requires otherwise.
